Utah: Governor Signs Bill Providing Certain COVID Liability Protections

The Governor of Utah has signed Senate Bill 5003, which provides certain liability protections when there has been exposure to the COVID-19 virus.

This new law may be of potential interest to some AKC-affiliated clubs with deep concerns about conducting their events while under a higher-than-normal exposure to liability risks.

Among other provisions, the new Utah law would protect any “person” (including individuals, associations, companies, and organizations and other entities) from civil liability for damages or injury “resulting from exposure of an individual to COVID-19 on the premises owned or operated by the person, or during an activity managed by the person.”

The exemption would not apply to willful misconduct, or reckless or intentional infliction of harm, and other laws regarding liability remain in place.
