Nebraska Update: Two Amendments Seek to Allow Forfeiture of Animals

The Nebraska Legislature is considering a series of measures that would make numerous changes to the state’s Commercial Dog Breeder and Operator Inspection Act.

In addition to Amendment 1149, a subsequent amendment (Amendment 1194) has been filed that would also allow for a situation where a dog owner could forfeit their animals for only a suspicion of animal cruelty.

Both amendments are similar in content.  Amendment 1194 further clarifies what the court may consider as appropriate “adoption alternatives” when an animal seized on probable cause of cruelty or neglect (these alternatives include humane societies or “comparable institutions and the protection of such animal’s welfare”).  These alternatives may only be considered if they possess the proper state licenses and have paid the fees.  The amendment also states that the court may prohibit an adopting or purchasing party from selling an animal for up to one year.

Both amendments are of significant concern.  When contacting the Nebraska Legislature, let them know you oppose BOTH Amendments 1149 and 1194, which would violate the rights of Nebraska dog owners.  Click here to find the name and contact information for your State Senator.  A full Senate roster may be found here.
